Terms of Service
These Terms of Service ("Terms") govern your access to and use of the World Poker Club website at worldpokerclub.co.uk and the application at app.worldpokerclub.co.uk (together, the "Service"), operated by World Poker Club ("we", "us", "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
01. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you confirm that you meet this minimum age requirement.
The Service is intended for use in jurisdictions where the activity of organising a home poker tournament is legal. You are responsible for ensuring your use of the Service complies with local laws applicable to you.
02. Your account
To use the application, you need to create an account. You agree to:
- Provide accurate, current, and complete information when registering
- Keep your password and 2FA credentials secure
- Take responsibility for all activity that happens under your account
- Notify us immediately if you suspect unauthorised access
We may suspend or terminate your account if you breach these Terms (see Section 10).
03. Acceptable use
You agree not to:
- Use the Service for any unlawful, fraudulent, or harmful purpose
- Attempt to gain unauthorised access to any part of the Service, other accounts, or our systems
- Reverse-engineer, decompile, or scrape the Service except as permitted by law
- Use the Service to send spam, malicious software, or any other harmful content
- Use bots, scrapers, or automated tools to access the Service without our written permission
- Interfere with or disrupt the Service or the servers that run it
- Use the Service to organise, facilitate, or take part in activity that is illegal in your jurisdiction
- Misrepresent your identity or impersonate another person
04. Your content & data
You retain ownership of all content you create or upload in the Service — tournament settings, player names, results, photos, and so on ("Your Content").
By using the Service, you grant us a limited, non-exclusive licence to store, process, and display Your Content solely for the purpose of providing the Service to you. We do not claim ownership of Your Content.
You are responsible for ensuring you have the right to share any personal information about third parties (e.g. players' names or photos) that you upload, and that those individuals are aware their data is being processed by our Service. See our Privacy Policy for more.
05. No gambling services
It is your responsibility to ensure that any money handling, betting, or prize distribution related to your tournaments complies with the laws of your jurisdiction. We provide tooling — we do not provide a gambling service, are not licensed by the UK Gambling Commission, and have no involvement in any wagers placed using our software.
06. Our intellectual property
The Service — including the website, application, design, code, logos, branding, and all related materials — is the intellectual property of World Poker Club or its licensors. It is protected by UK and international copyright, trademark, and other laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal use in accordance with these Terms. You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service without our prior written permission.
07. Service availability & changes
We work to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be unavailable from time to time due to:
- Scheduled maintenance
- Technical failures or outages
- Events outside our reasonable control (force majeure)
We may, at our discretion, modify, suspend, or discontinue any feature of the Service at any time. We will give reasonable notice of significant changes where practical.
08. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranty of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that:
- The Service will meet your specific requirements
- The Service will be uninterrupted, timely, secure, or error-free
- Any errors in the Service will be corrected
- Calculations performed by the Service (e.g. payouts, leaderboard rankings) will be free from error in every case — although we take care to make them accurate
Nothing in this Section limits any rights you have as a consumer under UK law that cannot be excluded.
09. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
- We are not liable for any loss of profits, revenue, data, business opportunities, or goodwill
- We are not liable for any disputes between you and your players, including any disputes over money, results, or conduct
- Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) £50, or (b) the amount you have paid us in the 12 months preceding the claim
We do not exclude or limit liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded under English law.
10. Termination
You may stop using the Service and close your account at any time by contacting us.
We may suspend or terminate your access to the Service immediately, without notice, if:
- You breach these Terms
- We reasonably believe your use of the Service is unlawful or harmful to other users
- We are required to do so by law
- We decide to discontinue the Service (with reasonable notice where practical)
Upon termination, your right to use the Service ends immediately. The Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall continue to apply.
11. Governing law & jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the law of England and Wales.
You agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim. If you are a consumer based in another part of the UK, you may bring proceedings in your local courts as permitted by law.
